DUI / DWI in New Mexico
DWI law is a very complicated and ever-changing area of the law. Due to increasing demands from the Federal government, groups like MADD (Mothers Against Drunk Drivers), and pressure from the public, the legislatures and the Courts have reacted by making the penalties for DWI ever harsher, and have continued to make defense of DWI/DUI cases more and more difficult.
Mr. Cain began working in 2001 as an Assistant District Attorney (prosecutor) at the District Attorney’s Office in Las Cruces, where he worked for three and one-half years. During that time, he prosecuted the majority of DWI cases in that office. Also, he was trained and certified at the Las Cruces Police Department in 2002 on the Standardized Field Sobriety Tests (SFST’s). This, along with his continued research and education on the changing laws, have given him a wealth of experience from which to draw to defend your case.
We defend DUI-DWI cases differently than any other law firm in the area. We utilize the services of our investigator, a retired Doña Ana County Sheriff’s Office Investigator, with over 30 years law enforcement experience. He starts at “square one”, and completes an investigation like the police should have done initially. He will run background checks on the other parties, witnesses, and even the officers themselves.
He also interviews all of the State’s witnesses and provides our witnesses to the District Attorney to interview. Our experience has been that when ALL of the facts are known….the facts HELP the defense, not hurt it. We dig deep into your case so that even if we cannot get your case dismissed, we are able to get overwhelmingly good resolutions for our clients.

Costs
At The Law Office of Michael E. Cain, we charge $3750 for a misdemeanor DWI. (Plus $25 MVD hearing fee and New Mexico Gross Receipts Taxes). This fee includes our investigator’s fees as well. You are getting both an attorney AND an investigator for less than most attorneys charge for just an attorney.
Felony DWI’s are priced at $4895, (Plus $25 MVD hearing fee and New Mexico Gross Receipts Taxes).
